Papa John’s has agreed to pay a total of up to $20 million to settle the Class Action Litigation and the Collective Action Litigation.
The highest individual settlement award is $2,248.18; the average award is $258.77; and the lowest award is $25. The exact value of your settlement award is calculated based on the amount of time you worked.
If you received a notice, you are probably part of the lawsuit.
Individuals who worked at a Papa John’s corporate-owned location as a delivery driver in Colorado at any time between February 12, 2016 and October 3, 2022; in Florida at any time between February 12, 2014 and October 3, 2022; in Illinois at any time between February 12, 2009 and October 3, 2022; in Kentucky at any time between February 12, 2014 and October 3, 2022; in Maryland at any time between February 12, 2016 and October 3, 2022; in Minnesota at any time between February 12, 2013 and October 3, 2022; or in Missouri at any time between February 12, 2014 and October 3, 2022.
In addition to the states highlighted, the settlement also includes individuals who submitted a “Consent to Join” form. If you have joined the lawsuit and are not in the states we have highlighted, you may still be entitled to an award.

It may be soon after the final approval hearing which will be held on July 27, 2023 or it may be some time after that hearing.
The method of payment is by check.
Head to www.pizzadeliverydriversettlement.com to submit a form online, go to the notice and claim form tab at the top, then click the word “here” in the first paragraph where it states, “If you wish to file a Claim Form, please click here to submit a Claim Form online”. This will take you to the claim form portal where you will be prompted to enter your username and password. You must use the unique username and password that was issued to you and can be located near your name and address on the Notice mailed to you and in section 4 of the Notice emailed to you.

The Effective Date is the date which the Judgment in the Lawsuit becomes final. The Effective Date is likely to be 1 day after the appeals period. The appeals period is estimated to be 31 days after final approval, assuming that no objections have been made.
You will receive no money. You will only receive your settlement award if you submit a claims form by June 20, 2023. Please go to the “NOTICE & CLAIM FORM” page and submit your claims form or return the claim form that was mailed to you as soon as possible.

Attorney fees can only be granted by the Court. A final approval hearing to address the settlement, attorney fees, costs, and service payments is scheduled on July 27, 2023, at 10:15 am in Courtroom 621, US District Court for the Southern District of New York, The Hon. Charles L. Brieant Jr. Federal Building and United States Courthouse, 300 Quarropas St., White Plains, NY, 10601-4150. Class Counsel is requesting 33.3% of the award, one-third of the Gross Settlement Fund, and reimbursement for their out-of-pocket costs reasonably incurred in the Class Action Litigation and the Collective Action Litigation, which, if approved by the Court, will be paid out of the Gross Settlement Fund. Counsel believes the amounts for attorneys’ fees and costs requested are fair and reasonable.
If I am still working for Papa Johns or if I need to sue Papa John’s again in the future, does this settlement impact any future claims I can bring against Papa John’s?
What if I don’t agree with the settlement or the amount I am to receive?
If you choose to be included in this case, and receive money or benefits from the settlement, you give up any rights to separately sue PJI about the same claims in this lawsuit. If you wish to be excluded from the Class, you must submit a written statement requesting exclusion from the Class on or before the Claim Deadline (a “Request for Exclusion”). The Request for Exclusion must state: “I exclude myself from the Papa John’s delivery driver settlement. I affirm that I was an employee of Papa John’s.” The Request for Exclusion must include your full name, address, telephone number, the last four digits of the Social Security number you used when working for Papa John’s. The request must be signed by you. An incomplete or unsigned Request for Exclusion will be deemed invalid. If you choose to exclude yourself, you will not receive any money from this settlement.
The exact value of your settlement award is calculated based on the amount of time you worked. To exclude yourself from the Settlement Class, you must submit a written letter requesting exclusion from the Class and Collective Action Settlement (“Request for Exclusion”). You may tell the Court that you do not like the Settlement or some aspect of the Settlement. A portion of your settlement payment will be considered reimbursement of self-paid business expenses and a portion will be considered statutory penalties.
